1. Acceptance of Terms
By accessing or using akimycar ("the Platform"), you agree to be bound by these Terms of Service. If you do not agree, please do not use the Platform. These terms apply to all visitors, users, customers, and providers who access or use the Platform in Kenya.
2. Definitions
- "Platform" means the akimycar website, mobile applications, and related services.
- "Customer" means a user who books services, purchases products, or requests roadside assistance through the Platform.
- "Provider" means a verified business or individual who offers automotive services or sells products through the Platform.
- "Service" means any automotive service listed on the Platform, including but not limited to repairs, detailing, tyre fitting, and inspections.
- "Booking" means a confirmed appointment or request for a Service made through the Platform.
3. User Accounts
To use certain features, you must register for an account. You agree to provide accurate, current, and complete information during registration and to keep your account information updated. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. akimycar reserves the right to suspend or terminate accounts that contain false information or are used to violate these terms.
4. Provider Terms
Providers must pass akimycar's verification process before listing services or products. Providers warrant that they hold all necessary licences, insurance, and qualifications to perform the services they offer. Providers are independent contractors and not employees of akimycar.akimycar acts as a marketplace connecting Customers with Providers and is not directly responsible for the quality of work performed.
5. Bookings and Payments
When you make a Booking, you agree to pay the listed price, including any applicable taxes and fees.akimycar uses a hold-and-release payment system: funds are held until the service is completed to your satisfaction. For product purchases, payment is processed at checkout and delivery terms are as specified by the seller. All prices are displayed in Kenyan Shillings (KES).
6. Cancellations and Refunds
Customers may cancel a Booking without penalty up to 24 hours before the scheduled appointment. Cancellations within 24 hours may be subject to a cancellation fee at the Provider's discretion. Refunds for product purchases follow the individual seller's return policy, which must comply with Kenyan consumer protection law. Disputes are handled through akimycar's dispute resolution process.
7. Reviews and Content
Users may submit reviews, ratings, and other content. You retain ownership of your content, but grant akimycar a non-exclusive, royalty-free licence to use, display, and distribute it on the Platform. You agree not to submit false, defamatory, abusive, or unlawful content. akimycarreserves the right to remove content that violates these terms or is deemed harmful to the community.
8. Limitation of Liability
akimycar provides the Platform on an "as is" and "as available" basis. While we vet Providers, we do not guarantee the quality, safety, or legality of services performed. To the maximum extent permitted by Kenyan law, akimycar shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Platform or any services booked through it.
9. Termination
akimycar may suspend or terminate your access to the Platform at any time, with or without cause, and with or without notice. Upon termination, all licences granted to you will cease, and you must immediately stop using the Platform. Provisions that by their nature should survive termination shall survive, including ownership, warranty disclaimers, and limitations of liability.
10. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the Republic of Kenya. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of Kenya.
11. Changes to Terms
akimycar reserves the right to modify these Terms at any time. We will notify users of material changes via email or through the Platform. Your continued use of the Platform after changes constitutes acceptance of the revised Terms.
